Abstract
The 40-day war (Ramadan 1447 / Spring 2026), initiated by the military aggression of the United States against Iran, resulted in extensive destruction of Iran's cultural heritage. The primary question of this research is: which categories of international crimes were realized through the destruction of Iranian cultural sites during this aggression, and how can the responsibility of the aggressor state be explained based on treaty and customary obligations? Employing a descriptive-analytical research method by applying relevant instances to international judicial practice, this article evaluates the actions of the aggressors under international instruments and obligations, including the 1954 Hague Convention, its First Protocol, the 1972 World Heritage Convention, and customary rules 38 and 40 of international humanitarian law. The findings demonstrate that the destruction of Chehel Sotoun Palace, the National Museum of Iran, and the Mausoleum of Ferdowsi constitutes a war crime and, upon establishing discriminatory intent, a crime against humanity. Furthermore, both individual criminal responsibility of commanders and international responsibility of the aggressor states are substantiated.
